Hearing to Amend Statement of Claim in SRC's Suit Against Nik Faisal, Ihsan Perdana Fixed for Aug 3

KUALA LUMPUR (June 8): The High Court (Civil Division) will hear the proposed amendment to the statement of claim in a RM167 million suit filed by SRC International Sdn Bhd and its two subsidiaries, against its former managing director Nik Faisal Ariff Kamil, Ihsan Perdana Sdn Bhd and two of its company directors, on Aug 3.

The hearing date before Judicial Commissioner Datuk Raja Ahmad Mohzanuddin Shah Raja Mohzan was fixed by High Court deputy registrar Ong Yen Li on Thursday (June 8) following case management.

This was confirmed by counsel Kwan Will Sen who appeared for SRC and its subsidiaries Gandingan Mentari Sdn Bhd and Jaringan Mentari Sdn Bhd.

Last month, Raja Ahmad also fixed dates for a 12-day hearing of the suit from Oct 1, 2024.

SRC, Gandingan Mentari and Jaringan Perdana have named Datuk Dr Shamsul Anwar Sulaiman, Datuk Abdul Aziz Ismail and Ihsan Perdana to recover RM167 million.

The sum comprises RM123 million that SRC provided as a grant to Ihsan Perdana between December 2014 and April 2015, and a sum of RM44 million that SRC and its subsidiaries gave the company — purportedly for corporate social responsibility purposes — between April 2015 and July 2015. At the time of the alleged incidents, Shamsul Anwar was Ihsan Perdana's managing director and Abdul Aziz a director.

Nik Faisal, a former MD of SRC, who has left the country and is still at large, was also named in the suit. SRC and the subsidiaries have obtained a judgement in default against him in the matter.

The suit is part of the 16 suits that were filed by SRC, in addition to six more by 1Malaysia Development Bhd (1MDB) and its subsidiaries in May 2021.

SRC is also a former subsidiary of 1MDB.
