Dr M says he supported Najib's decision on ceasing payments to Sultan Sulu's heirs

KUALA LUMPUR: Tun Dr Mahathir Mohamad today explained that he supported the decision made by former prime minister Datuk Seri Najib Razak in 2013 to cease the annual cession payment to the heirs of the Sultan of Sulu following the incursion in Lahad Datu, Sabah.

Berita Harian reported that the former two-time prime minister, however, raised questions on whether the decision was made according to the provisions of law apart from fulfilling all the obligations to terminate the old agreement to avoid future dispute.

"At the time, Najib had said that he will not pay (the cession payment).

"And at the time, I had only supported his decision. (However), he was the one who had made such a decision. 

"I was, however, told that the decision was not referred to the cabinet and the Dewan Rakyat (in 2013), and that he was making his own decision," Dr Mahathir said after a talk on the future of online teaching and learning here today.

Dr Mahathir, who is Langkawi member of parliament, is a panel member at the programme, which was organised by online education platform, PTTI.

When elaborating on the issue, Dr Mahathir said the government at the time should have carried out a comprehensive study including ascertaining that the terrorist responsible for the intrusion in Lahad Datu had indeed involved the Sultan of Sulu's heirs before coming to the decision to cease the cession payment.

"We should have conducted a study and ascertained if the heirs of the Sultan of Sulu were indeed responsible for the attack (on Lahad Datu).

"Only after that, we should have ceased the payment.

"This however was not the case. Without any study taking place, we ceased the payment,"

Dr Mahathir said because of that, those who claimed they are the heirs of the Sultan of Sulu had brought the matter to the international arbitration court.

"Because of that, we are facing this problem now. There was no such problem previously. Every year we made the payment.

"When we decided to cease the payment, they brought the matter to the (arbitration) court in Spain. We, however, did not recognise the (arbitration) court in Spain.

"Before a decision was made, both parties should present their submission to defend their position," said Dr Mahathir.

He also cited the case of Pedra Branca, in which Malaysia agreed with the parties who made such a claim and refer to the matter to court.

It was reported that assets of two Petronas subsidiaries in Azerbaijan were seized by bailiffs for the heirs of the now-defunct Sulu sultanate, who were claiming US$14.92 billion (RM62.59 billion) from Malaysia earlier this month.

Bernama, which quoted the Financial Times, reported that lawyers for the plaintiffs reportedly seized Petronas' assets registered in Luxembourg, namely Petronas Azerbaijan (Shah Deniz) and Petronas South Caucasus, with a reported value of over US$2 billion (RM8.8 billion).

Since then, Malaysian has been granted by the Paris Court of Appeal in France, a stay on the enforcement of the Final Award on claims by parties claiming to be heirs and successors-in-interest to Sultan Jamalul Kiram II.

Mind you, before Sulu agreement, there is actually Sultan Brunei agreement a year before which stated it's handover of Sabah to British! This agreement rarely mention by Malaysia! Why! Supposely, Malaysia should let the world knows that the valid agreement is between Sultan Brunei and British not with Sultan Sulu!

The british rent sabah from the sulus mah!

As long as the rent are paid.....the sulus cannot intervene with sabah loh!

But year 2012, msia govt under najib, refuse to pay rental....thus the contract of perpetuity is claimed terminated loh!

So the sulus sue msia & won USD 15B mah!
But this is a private litigation, no sovereign issue is involve loh!

As long as msia, willing to settle USD 15B for sabah issue to the sulus or philipines there will be no issue loh!

Of course msia is not willing to pay this huge sum....thus msia govt appealing loh!

The issue is how much is the quantum of damages msia govt must pay loh!

It all rest with the appealed court outcome loh!

"HISTORY THAT NEEDS TO BE KNOWN BY THE DESCENDANTS OF SULTAN SULU AND THE PEOPLE OF SULTAN KIRAM D SOUTHERN PHILIPPINES"

THE STATE OF SABAH was a colony under the STATE of BRUNEI DARUSSALAM as early as the reign of the first SULTAN OF BRUNEI, SULTAN MUHAMMAD SHAH (AWANG ALAK BETATAR) (Year 1363 ~ 1402 AD) until the end of the 19th century for 500 years.

During the BRUNEI Civil War (1661 ~ 1673), SULTAN MUHYIDDIN had promised the East Coast Region of SABAH to his cousin SULTAN SULU if he helped him fight SULTAN ABDUL HAKKUL MUBIN (who was fortified on CHERMIN ISLAND in KUALA SUNGAI BRUNEI in 1673).

However, the SULTAN of SULU did not carry out the task given to him well, causing the wrath of SULTAN MUHHYIDDIN who refused to hand over SABAH to the Sultanate of SULU. Since then, the SULU Sultanate has only claimed the East Coast Region of SABAH. This is evidenced from the note "THE HISTORY OF JAVA" by SIR THOMAS STAMFORD RAFFLES in 1817 who said that "On the north ~ east of BORNEO proper (BRUNEI) lies a very considerable territory (SABAH), the sovereignty of which has long been claimed by SULU GOVERNMENT. "[CLAIMED = MENUNTUT, bukan bererti" MENGUASAI "]"

Until 1865, SULTAN ABDUL MOMIN, BRUNEI had leased the Western Province of SABAH (claimed by the SULTAN of SULU) to CHARLES LEE MOSES (C.L. Moses then sold his rights to W.J. TORREY and TORREY sold his rights
to BARON VON OVERBECK, Consul of the Austro ~ Hungarian Empire in HONG KONG). BARON VON OVERBECK together with ALFRED DENT (HONG KONG) later established the DENT COMPANY.

In 1877, BARON VON OVERBECK went to BRUNEI to make a new lease agreement with SULTAN ABDUL MOMIN. Sultan Abdul Momin BRUNEI has appointed him MAHARAJA SABAH and RAJA GAYA and SANDAKAN.

Realizing that the SULTAN SULU also claimed the East Coast Region of SABAH at that time, BARON VON OVERBECK also made an Agreement with the SULTAN SULU on the East Coast Region of SABAH which the SULTAN SULU claimed as a guarantee to avoid problems in the future (and he was appointed by the SULTAN OF SULU as RAJA SANDAKAN and DATO 'BENDAHARA).

The lease amount for the Coastal Region of SABAH paid by BARON VON OVERBECK to the SULTAN OF BRUNEI is $ 12,000.00 per annum and $ 3,000.00 to TEMENGGONG BRUNEI, while the money paid to the SULTAN of SULU was $ 5,000.00 per annum under the agreement of BARON VON OVERBECK with the SULTAN of SULU in 1878. BARON VON OVERBECK then sold all his rights to ALFRED DENT, Founder of the BRITISH NORTH BORNEO COMPANY, who administered SABAH (NORTH BORNEO) 1882 ~ 1946, which later handed it over to the BRITISH Government.

If you look at the SABAH lease documents in December, 1877 there is a condition that if BARON VON OVERBECK or his successor does not pay the lease rent for three (3) years then the SULTAN OF BRUNEI/ TEMENGGONG BRUNEI has the right to take back all the East Coast Territories of SABAH leased it. But BRUNEI is NOT claiming SABAH. This is because the people of SABAH had chosen MALAYSIA in 1963, that is a respected choice though
felt sad in the hearts of some BRUNEI people at the time. And until now, the relationship between the PEOPLE of BRUNEI and SABAH (MALAYSIA BORNEO) remains close as relatives, even if they do not live in the same house (COUNTRY), they still sit next door (NEIGHBORHOOD COUNTRY), remain friendly and respect each other. Those who are entitled to "NO" demand, on the other hand those who are "NOT RIGHT" ("SULU SULTANATE") who constantly want to demand.

Attached herewith are the relevant SABAH lease agreement documents in 1877, namely:

● PROOF ~ PROOF SABAH WAS UNDER THE GOVERNMENT OF BRUNEI DARUSSALAM UNTIL 29TH DECEMBER, 1877 AND BEFORE THAT WAS NEVER SUBMITTED TO ANY COUNTRY/ GOVERNMENT (INCLUDING "SULU SULTANATE"). ●

These original documents are kept in PUBLIC RECORD
OFFICE, LONDON, UNITED KINGDOM and has COLONIAL OFFICE reference numbers: 874/2, 874/17, 874/18, 874/19 & 874/20.

Whether Sabah is own by brunai or sulus....the conclusion is the same for msia mah!

The fact that the British has an agreement with the Sulus....and everything is fine with the agreement until Msia refuse to pay the rental....means the british has done it right & valid mah!

The najib govt blow it mah!

Right now....the damages of USD 15b already establish....the question how could msia govt mitigate the situation leh ??

Msia only pays nominal Rm 6k per annum.....now the Court says msia need to pays usd 15b ...for termination of contract for none payment of rental loh!

Whether berunai govt, or philipine govt or sulus own sabah....it is immaterial....bcos the court conclude if msia willing to pay USD 15b....everything will be settled mah!

Of course msia refuse to pay such a staggering sum loh!

The question....is how much should msia govt pays loh!

This is to be decided by the court during the appeal loh!
