KOTA KINABALU: The High Court here granted the federal government's application to stay judicial review proceedings filed by the Sabah Law Society (SLS) concerning the 40 per cent special grant for Sabah.
SLS president Roger Chin said judge Datuk Ismail Brahim delivered his decision via e-review today.
"This means SLS will first have to successfully defend the High Court's decision given on Nov 11, 2022, before the judicial review can proceed further to a full hearing," he said in a statement.
On Nov 11, 2022, the High Court granted SLS's leave application on the grounds that it had locus standi to file for a judicial review as this was a public interest case.
The federal government then filed an appeal at the Court of Appeal to set aside the High Court's decision.
"As SLS brought this judicial review as a public interest litigation ultimately for the people of Sabah, SLS assures the people that they would rigorously oppose the appeal in the Court of Appeal.
"SLS will also request the Court of Appeal to hear the appeal as soon as possible. SLS shall keep the public informed on further developments of this case," he added.
SLS had filed the leave application on June 9 last year following an April 14 announcement by the federal and state governments of a special five-year annual grant of RM125.6 million for Sabah.
The Sabah government subsequently applied and was also allowed to intervene as the second respondent in the application.
