Folks, the Delhi High Court yesterday allowed a plea to implead DGCA as a party to a public interest litigation (PIL) seeking quashing of approvals being granted by the Centre to operationalise the USD 30 million deal between Tata Sons and Malaysia-based AirAsia.

A bench fixed the PIL of BJP leader Subramanian Swamy and the plea of Federation of Indian Airlines against the Tata-AirAsia deal for final hearing on May 1.

"The government has lied to the court and they should not be permitted to go ahead with the deal," Swamy said.

"Nothing is going to happen till May 1," the bench said, adding that it will also take up the contempt plea of Swamy for hearing on that day itself.

So how now, folks? Hahahahahahahaah!!

At current share price that is 2.32 AA only paying investors less than 1.75% per share so equivalent to 2,781,034,580 shares at 4sen = Rm111m payout for dividend.

Remember folks, AA has promised a 20% dividend policy of it net operating profit so equivalent to Rm653.104m x 20% = Rm131m!

So folks, will the local & foreign funds be happy for anything less than as promised? Maybe knowing the dividend going to be lower that have triggered them to sell slowly & surely lately!

Now the big question: will the selling stop? Hint: As mentioned by the management, FY2014 & 2015 will be difficult year! If a business don't do well stock eventually follows!

Folks, Airasia has a dividend policy of 20% its net operating profit & that come to a staggering rm131m for FY2013 dividend.

But folks, AA profit after tax for FY2013 was only at rm364m. Now the big questions: will there be dividend payout to shareholders? If there is, will foreign & local funds be happy anything less than rm131m as dividend?

On the other hand AA trying their best to conserve cash by selling 6 existing aircraft & reduce cost by deferring 19 aircraft deliveries! Even the share buy-back has not materialized!

Folks, if a business don't do well, the stock eventually follows! Don't believe look at the share price now, way near it year low, folks!

The Indian Aviation Ministry said AirAsia's application for the permit was made to the Directorate General of Civil Aviation last October, 2013.

"The issuance of air operators permit is subject to applicant company fulfilling all conditions as per laid down rules and its outcome can not be stated at this point of time since the process is still on. The decision shall be subject to the decision of the Delhi High Court," a senior DGCA official said.

The petition will come up for hearing on Wednesday, 23 Apr 2014 and the issue of permit will be subject to the outcome of the petition, the civil aviation ministry said. Time will tell! Hahahahahahahahah!!

Folks, latest news Indian DGCA set to issue AirAsia permit this week!

But folks, the Delhi High Court is currently hearing this issue over the interpretation of the foreign direct investment in civil aviation sector and AirAsia and Tata-Singapore are two cases in front of it and nobody knows when the Delhi High Court will finally dispose off this matter because the next date of hearing is April 23.

As of now folks, it seems the civil aviation ministry is taking a stand which is very different from the stand it had earlier taken. Earlier, it believed, it did not have to wait for Delhi High Court’s verdict as it was expected to be a parallel matter. So how now? Hahahahahaha!!

Bloomberg reported that the decision to ease growth plans at AA Group is a rare display of caution following Fernandes’ expansion across the continent, as the region absorbs some of the largest aircraft orders in recent years.

After taking 150 planes in 13 years for bases in Malaysia, Thailand and Indonesia with 350 more in the backlog, TF said that he was ready to take a “back seat”, deferring 7 deliveries this year and 12 in 2015 to help adapt to a climate where rivals are flooding the market.

Malaysia continues to record some of the world’s fastest passenger growth rates, driven by rapid capacity expansion by Malaysia Airlines (MAS) and AirAsia along with the launch of Malindo Air. Malaysia Airports has recorded 18% passenger growth for 1Q2014, including 16% at Kuala Lumpur International Airport (KLIA).

But folks, the rate of growth is expected to slow down for the remainder of 2014 but remain in the double digits for the full year. The growth over the last year has been spectacular but has come at the expense of airline yields and hence profitability.

Folks, Airasia at this current price a bargain buy or a value trap stock?

Remember folks, the aggressive expansion strategies of aviation peers & four more new LCCs – Thai AirAsia X, Indonesia AirAsia X, NokScoot and Thai VietJet Air – joining the fray this year has led to overcapacity within Southeast Asia.

These expansion strategies would add 88 new aircraft to bring fleet size to 573 in Southeast Asia by the end of 2014.

AA on the other hand Airasia has deferred 7 aircraft delivery in 2014 and 12 in 2015 in which after the deferral will take 28 A320s in 2014. AA expects to sell 6 existing aircraft to fund the deliveries.

So the big question: will there be growth in AA? Hmmmmmmm..!!

Folks, AirAsia Zest received the most number of complaints from airline passengers in the first quarter, data from the Civil Aeronautics Board showed. Data said AirAsia Zest/Zest Air logged the most number of complaints at 87, followed by Cebu Pacific with 29, Philippine Airlines with 24, PAL Express with 18 and Tiger Airways with 15.

The CAB said the types of complaints included canceled flights due to network re-alignment with 50, delayed refund with 50, delayed flights with eight, lost baggage/package with 13, poor customer service with 8, damaged baggage/goods with 6, and rebooking with 6.

The Indian Directorate General of Civil Aviation has stipulated that a scheduled Indian airline cannot enter into an agreement with a foreign investing institution or a foreign airline which could give these foreign entities the right to control the management of the domestic operator.

So folks foreigners will not control management of Indian. The big question: can AA India survive the Indian competitive market without help from AA Group? Hmmmmmmm...!! Time will tell!

SINGAPORE Airlines' (SIA) passenger load factor fell 4.3 percentage points to 75 per cent last month, as passenger carriage declined and capacity remained flat.

HONG KONG:China Southern Airlines, the country's largest carrier by fleet size, warned of a loss of more than $50 million in the first three months of the year as it was hit by exchange losses cause by a weaker yuan.

In a filing to the Hong Kong Stock Exchange the firm said it would lose 300-350 million yuan ($48.2-$56.3 million) in January-March. That compares with a net profit of 57 million yuan in the same period last year, the filing said.

Folks, if the Government is mindful of bowing to the pressure of AirAsia/AirAsia X, in all fairness the same percentage of preferential or fixed airport charges must be applied to all carriers using KLIA and KLIA2.

In the interim, the Government should instruct MAHB to take actions against AA/AAX to pay up the Airport Tax debt of about RM7 million (as in June 2012 – it should be higher by now) that were paid by passengers who did not travel. The said RM7 million has been confirmed in Parliament by the Ministry of Transport.

AA/AAX only have the right to forfeit the fares paid by un-travelled passengers but not the Airport Tax. The Airport Tax should handed over to MAHB or Bank Negara as unclaimed money.

Folks, the Government must not be seen to be tolerating undue pressures from companies like AA/AAX and give them preferential or fixed airport charges for the use of KLIA2.

On 11-10-2012 the Ministry of Transport told Parliament that KLIA2 was not built specially for one particular airline.

Further, KLIA2 is built using public fund. AA/AAX has no right to demand for preferential or fixed airport charges. The cost of KLIA2 had to be recovered by MAHB through collection of airport charges.

Folks, the joint press statement by AA director Datuk Kamarudin Meranun and AAX Chairman Tan Sri Rafidah Aziz have finally let the cat out of the bag. They were talking about the negotiations on the airport charges to be levied against AA/AAX.

“However, should the negotiations not be completed or concluded expeditiously, we hope the Government will be able to provide necessary mediation, in order to enable MAHB to get its dues as the airport operator; and at the same time, enabling the AA Group to efficiently operate based on our proven low-cost carrier business model through reasonable charges and levies,” they said in the statement.

Folks, is safety a real priority to AA?

On 2-4-2014 Ms Aireen Omar of AA said that it will stay put in LCCT unless the “safety” issues are settled.

On 5-4-2014 PM announced that AA must move to KLIA2 on 9-5-2014. The PM also ticked off AirAsia for being arrogant.

AA was in the state of elegant silence for 10 days. Out of a sudden, it changed its tune yesterday and agreed to move to KLIA2 on 9-5-2014 despite its earlier stand on the so-called “safety” issues.

But AA/AAX no longer stressed on the so-called “Safety” issues in its latest joint statement of yesterday. It was stressing on wanting to negotiate on the new airport charges to be based on its “business model”.

Folks, on 1-4-2014 the Deputy Minister of Transport had announced that KLIA2 will be operational on 9-5-2014 and LCCT will be closed.

Despite notice of the closure of LCCT has been sent to AA, it was in the state of defiance by making it public that it will not move until the “safety” issues have been resolved.

MAHB and Ministry of Transport were made out to look like useless authorities with no sense of responsibility and that they will just open KLIA2 to the public without getting all the appropriate approvals from all the controlling authorities. This is the mentality of those managing AA.

Its statement was so arrogant . It came out with the excuse of KLIA2 was not safe for passengers. If safety is AA paramount objective then it would not have objected to the use of aerobridge that will cost only 20 Sen per passenger. It will be safer for the passengers and aircraft for passengers to use the aerobridge rather than walking on the tarmac.

But it strongly objected to the building of aerobridges in KLIA2.

Folks, of course, one cannot blame AA for taking things for granted because it owed only a small amount of Airport Tax in Jakarta if compared to the amount of more than RM130 million it owed MAHB spanning over more than five years.

When these Airport Tax debts became an issue in Parliament, AA had to settle the airport tax debt and it was granted a discount of not less than 25% by the previous Administration. Under such circumstances, the Government should have imposed interest and other penalty charges.

Unfortunately, AA was not accorded with special treatment in Jakarta like what it had received in Malaysia. It had to pay the Airport Tax debts in full in Jakarta.

Folks, a few years ago AA had threatened to move its headquarters to Jakarta for reason best known to itself. Presumably it thought that Indonesian authorities will bow down to their whims and fancies.

Recently has been reliably informed that AA has closed down its office in Jakarta and all its personnel have now returned to Malaysia quietly.

It must a very embarrassing event for AA otherwise it will be issuing statements or tweets and published by the Star Newspapers.

Fortunately or unfortunately, when it failed to pay the Airport Tax that it has collected from its passengers, Indonesian Aviation Authority with one go grounded 3 AirAsia aircraft without hesitation.

It immediately paid up the outstanding Airport Tax!

In a twist of events, AirAsia said Tuesday it will move into a new terminal for budget carriers that is scheduled to open here next month, backtracking from a decision it made earlier amid pressure from the government.

Citing safety and commercial issues, AirAsia issued a statement two weeks ago saying it would not move to the so-called KLIA 2 terminal.

The government responded by asking the International Civil Aviation Organization (ICAO) to conduct final checks before the scheduled official opening on May 2.

Acting Minister of Transport said AirAsia could complain to the international aviation body if it is still not satisfied with the facility.
