According to the agreement, Puncak Niaga Holdings Bhd (PNHB) has accepted the Selangor government offer for the takeover of the equity, liability and assets of Puncak Niaga and Syabas at a value of RM2.47 billion and RM3.11 billion each.

Based on the takeover price, what is the price for puncak share?

SPLASH is still awaiting the federal government’s decision on the
invocation of S114 of the Water Services Industry Act (WSIA). The water
committee is due to meet soon and a decision is to be forwarded to the
Cabinet. Gamuda alluded that S114 only allows the federal government to
take over the operations but not assets of the water companies. The
Federal Constitution also stipulates that “there shall be no law which
allows for confiscation of assets or properties without adequate
compensation”. This was in line with our view. Article 13 of the Federal
Constitution states that “no law shall provide for the compulsory
acquisition or use of property without adequate compensation.”

n addition, in the MOU between federal and Selangor state
governments, the federal government had allocated MYR2b to the
state to resolve the water asset acquisition issue. However, the state
government has stated otherwise.
