Malaysian Bar challenges Pardons Board decision to reduce Najib’s sentence

KUALA LUMPUR (April 30): The Malaysian Bar filed a judicial review application last Friday to seek a declaration that the decision by the Federal Territories Pardons Board in Jan 29 to halve Datuk Seri Najib Razak's jail sentence to six years and reduce the fine in his SRC International graft conviction to RM50 million is unconstitutional, void and unlawful.

The Bar, which filed the application at the High Court through Messrs Amir and Rajpal where it named the board and Najib as respondents, also seeks an injunction restraining the former prime minister from submitting any efforts to obtain a pardon until the conclusion of all cases against him, and till Najib publicly accepts responsibility for his actions and conviction and expresses repentance and remorse for his actions.

The application was made with an affidavit supported by the Malaysian Bar secretary Murshidah Mustafa and the application for leave (permission) is fixed before judge Datuk Ahmad Kamal Md Shahid on July 2.

Prior to this, Malaysian Bar had during its AGM in March passed a resolution by former president Zainur Zakaria for it to challenge Najib’s pardon.

Prior to this, Najib was sentenced to 12 years in jail and fined RM210 million by the Federal Court on August 23, 2022 when it affirmed the decision of the Court of Appeal and High Court with regards to charges on abuse of power, money laundering and criminal breach of trust of SRC International Sdn Bhd funds.
