Frankly speaking I am less bothered with the 'material litigation' as KHSB is really undervalue. KHSB is worth

I presume if KPS is to take KHSB private, the suit will have not much effect as KHSB is a subsidary of KPS and all KPS is to take it off it's listing & taken private.

So this Star Everest is acutally the development of a piece of land...so KHSB said that there is no financial and operational impact of the Suit on the Group as the carrying amount was fully impaired.

Kumpulan Hartanah Selangor Berhad announced that Star Everest Sdn Bhd (SESB) filed an action in Kuala Lumpur High Court Civil Suit No. 22NCVC-1066-11/2011 vide a Summons and Statement of Claim dated November 1, 2011, against SAP Holdings Berhad (SAP), a wholly owned subsidiary of the Company, claiming for breach of the Development Agreement, Business Alliance Cum Authorization Agreement, Forward Entitlement Agreement, Takeover Liabilities Agreement, Power of Attorney and Power of Attorney as Attorney for SAP (the Agreements), all dated February 21, 2004, between SAP and SESB in relation to the development of a piece of land held under HS(D) 20034, PT No. 26549, Mukim Batu, Daerah Gombak, Negeri Selangor Darul Ehsan measuring approximately 234.187 acres.

(i) Date of presentation of the Suit

The date of presentation of the Suit was on 1 November 2011.

(ii) The amount claimed for under the Suit

The amount claimed was not specified under the Suit as the Plaintiff is seeking for declarations that the Agreements ( as stipulated in the announcement dated 21 November 2011 ) are still valid and binding on SAP and that SAP has breached the terms of the Agreements. Arising thereto, the Plaintiff is claiming for general and exemplary damages to be assessed by the Court.

(iii) A confirmation as to whether SAP is a major subsidiary

We hereby confirm that SAP is a wholly-owned subsidiary of Kumpulan Hartanah Selangor Berhad ("KHSB").


(iv) The total cost of investment in SAP

The total cost of KHSB's investment in SAP is RM95,622,887.00.

(v) The financial and operational impact of the Suit on the Group

There is no financial and operational impact of the Suit on the Group as the carrying amount was fully impaired.

The expected losses, if any, shall be determined upon the assessment of damages by the Court.

The date of Hearing for the Suit has been fixed on 2 December 2011.
