Enough evidence that Zahid knew about misuse of charity foundation funds

KUALA LUMPUR: The prosecution in Datuk Seri Dr Ahmad Zahid Hamidi's corruption trial today contended that there was more than enough evidence to prove that he knew about the misuse of charity foundation Yayasan Akalbudi funds since 2014.

Lead prosecutor Datuk Raja Rozela Raja Toran said the former deputy prime minister's defence of pointing the finger at his former executive secretary for issuing the foundation cheques to pay for his credit card bills could not be believed.

She said there was overwhelming evidence to show that the issuance of the foundation cheques by Zahid's secretary, Major Mazlina Mazlan, was done within the knowledge and instructions of the accused.

"His defence that he had no knowledge of it is patently untrue. He is just making her a scapegoat when he is the one who should be taking responsibility," she said. 

Raja Rozela pointed out that it was Zahid who later instructed Mazlina to stop using the foundation cheques to pay his credit card bills when word got around that the Malaysian Anti Corruption Commission (MACC) had started making enquiries about the issue in early 2016.

She said MACC investigating officer Khairuddin Kilau, had confirmed this in his testimony.

The Deputy Public Prosecutor said this in her submission at the end of the prosecution's case against Zahid.

The Umno president is facing 47 charges, including 12 for Criminal Breach of Trust (CBT), eight for corruption and 27 for money laundering involving RM31 million of Yayasan Akalbudi funds.

For the CBT charges, Zahid is alleged to have used the funds to pay for his personal credit cards, insurance policies and road tax for his personal vehicles, among others.

He faces a maximum 20 years jail, whipping and fine if convicted of the offences.

At the end of her submission, Raja Rozela said the prosecution had made its case against Zahid and urged the court to order the accused to enter his defence.

She said the prosecution had adduced credible evidence on each and every ingredient of the offences, which was unshakeable despite cross-examination by Zahid's lawyers.

"The evidence from direct, circumstantial and documentary evidence led in the trial warrants the accused to enter his defence on all charges," she said.

The defence will reply to the submissions before High Court Judge Datuk Collin Lawrence Sequerah on Wednesday.
