Kfima is worth the money, i think. Technically, just above upper trendline since May 2010. So risk reward ratio is manageable. Cut loss at 1.70

UPDATES ON THE NAD AL SHEBA DUBAI RACECOURSE CONTRACT DISPUTE

Reference is made to the Company’s previous announcements dated 6th January 2009 and 26th February 2009 pertaining to the cancellation of the Contract (“Contract”) relating to the construction and completion of the main building works, external works and infrastructure works (“Cancellation”) of the Nad Al-Sheba Racecourse Project by Meydan L.L.C. (“Meydan”) which was awarded to the 50:50 joint venture (“JV”) between the Company and Arabtec Construction L.L.C. (“Arabtec”) and the arbitration process initiated by the JV in Dubai against Meydan (“DIAC case No. 02/2009”) for breach of contract and to enforce the JV’s rights and remedies, including the recovery of all amounts due under the Contract as well as damages.

The Company wishes to update the status of the above as follows:-

The arbitration Tribunal had since been constituted and procedural pre-evidentiary hearing steps undertaken in preparation for the evidentiary hearing;
In the course of the procedural pre-evidentiary hearing steps, the JV’s dispute and claims had been revised from time to time and at present, totals approximately AED2.8 billion.
Meydan has taken the position that the DIAC case No. 02/2009 have expired by effluxion of time. After deliberation, the arbitration Tribunal in DIAC case No. 02/2009 had on 9 June 2012 rejected conclusively Meydan’s submission that the arbitration proceedings have expired by effluxion of time.
Notwithstanding the arbitration Tribunal’s decision above, the Company received information on 26 June 2012 that Meydan has on 14 June 2012 brought its counterclaims in relation to what was DIAC Case No. 02/2009 before the Dubai Courts under Commercial Action No. 1066/2012 (“Civil Suit”), claiming jointly against the Company and Arabtec, a sum of AED3.5 billion.
The Company is of the opinion that the Civil Suit is frivolous and without merit. In addition, there is a valid and binding arbitration agreement between Meydan and the JV and any dispute between the parties must be resolved by way of arbitration;
The Company will continue to pursue its claim pursuant to the on-going arbitration proceedings and will take all necessary steps to defend and/or oppose the Civil Suit filed by Meydan.
