HHRG Served Court Order for Mareva Injunction to Freeze RM58.18m Assets

KUALA LUMPUR (May 30): HHRG Bhd (KL:HHRG), which was slapped with a RM58.18 million suit by its former executive chairman Ooi Chieng Sim, said it had received the sealed copy of the court’s order pertaining to a Mareva injunction against the group.

In statement on Wednesday, HHRG said it had received a letter dated May 29 from Messrs Shafee & Co, the solicitor acting on behalf of the plaintiff.

The suit, filed by Ooi and his private vehicle Skylitech Resources Sdn Bhd, named HHRG as a defendant alongside managing director H’ng Choon Seng and deputy MD Kee Swee, as well as three of HHRG’s units.

Pursuant to the claims, Ooi alleged that HHRG’s three units — HK Gua Musang Sdn Bhd (HKGM), Fibre Star (M) Sdn Bhd (FSM) and HK Kitaran Sdn Bhd (HKK) — had defaulted on payment for RM10 million worth of loans he provided.

HHRG said the court order for the Mareva injunction restrains the company from withdrawing up to the value of RM58.18 million from its bank accounts, pending the disposal of an inter-parte hearing.

The company said it is also restrained from removing from Malaysia any of its assets, whether owned legally or beneficially by the defendants, and whether in the defendants’ name.

HHRG said pursuant to the court order, each of the defendants must, within seven working days on being served the injunction order, notify the plaintiff’s solicitor of the form, value, location and details of all their respective assets in Malaysia, whether or not they are in their own names or beneficially owned by them, and whether they are solely or jointly owned.

HHRG said it had instructed its solicitor, namely Messrs YC Wong, to take all necessary actions, and pursue all available remedies to defend and protect the company's position, including filing an application to set aside the injunction order with immediate action in adequate time.
