On behalf of Datuk Sow’s regarding your email dated 23^rd January 2015

We refer to your email below dated 23^rd January 2015. Having consulted our lawyer and the Board of Director and I regret to inform you that I am not able to provide you with the detail you seek as I am also governed by Data Protection Act and the responsibility to ensure the sensitive details of the company's shareholders and dealings.

As you are aware, unscrupulous person or persons have attempted to damage the company's good name by posting half baked documents, half of the true story and concocted a bad image of the company. We are in the midst of lodging the necessary reports as well as seeking the assistance of the relevant authorities to address this issue. We are also providing cooperation to the said authorities to resolve this issue and book the culprits.

To share with you, we had requests for shareholders list by unknown individuals using the names of our existing shareholders and when contacted, the said shareholder claims to have not made such request.

As such, in the interest of full and frank disclosure and accountability to all those who make such request and as well as to maintain our shareholders sensitive information, I would be happy to assist you if you could provide me with your full detail and purpose you seek the said information.

As you may have read my email of 23/1/2015 to him, the main queries are :

1  The authenticity of all those documents of the Disposal as appeared in the

                 said online news

2  Whether there was indeed an official complain already lodged with the

                 Securities Commission of Malaysia and if yes, what is the stage of the

                 investigation

3  Whether Abdul Razad Bin Ahmad is an employee of DPS Resources Berhad at

                 the material time of the Disposal

4  Whether Chin Wan Ling is an employee of DPS Resources Berhad at the

                 material time of the Disposal and still is

5  Whether Fong Hui Fong is an employee of DPS Resources Berhad in the period

                 between October 1, 2011 and December 31, 2013.

6  Whether Vincent Ng Chin Wee is an employee of DPS Resources Berhad or an

                 employee in any of your private companies at the material time of the  Disposal

7  Whether Vincent Ng Chin Wee is indeed your nephew

8  Where and when did you graduate with the Doctor of Philosophy degree 

9  Where and when did Fong Hui Fong, a former director of DPS Resources Berhad,        

     "graduate" with a Doctor of Philosophy degree

"Dr" Sow or that of DPS Resources Bhd's procrastination/refusal in answering my above queries was basically premised on the assumption or believe that :

1  Data Protection Act

2  Allegedly some persons have been on a DPS-smearing campaign

3  He will be"happy" to assist if I give my full detail and purpose of requesting

I will now go categorically in detail on what ground "Dr" Sow or DPS Resources Berhad hold in refusing or witholding informations/answers to my queries.

Firstly Data Protection Act. I would assume what he meant was Personal Data Protection Act 2010, which came into force only on 15 November 2013. For a "Dr" to cite Personal Data Protection Act 2010 as a blanket pretection or a shield for refusing to answer my queries only goes to show how he got his "PhD" degree indeed is questionable. (Ironically, this would have answered my Question 8 on where he graduated with that doctorate degree, LOL)

There is no point for me to teach the subject of laws here, as the essence of Personal Data Protection Act 2010 is best described by http://www.pwc.com/my/en/services/what-is-pdpa.jhtml  

Go on and read it. You will concur with me.

DPS-smearing campaign - whether there was indeed a smearing campaign now on DPS Resources Bhd remain to be seen, until and unless he or DPS Resources Bhd can show proof that they have done the necessary things like " in the midst of lodging the necessary reports as well as seeking the assistance of the relevant authorities to address this issue. We are also providing cooperation to the said authorities to resolve this issue and book the culprits ....". As a matter of fact, this is what initiated my first email query as I became aware that there was a complain already lodged with the Securities Commission of Malaysia ("SC"), and the official reply from SC was also evident on various websites. That bring us to my Question No. 2  : whether there was indeed an official complain already lodged with the Securities Commission of Malaysia and if yes, what is the stage of the investigation. Why can't he or DPS Resources Berhad just answer a simple YES or NO ?

The way "Dr" Sow answered Question 2 fall precisely in the meaning of a famous Chinese proverb "做贼喊捉贼 " (disguising one's thief nature while pretending to be a good man, of sort).  I rest my case.

Thirdly, He will be"happy" to assist if I give my full detail and purpose of requesting, this is the biggest joke I have today. "Dr" Sow spent three quarter of his email "busy touting" how he is protecting the sensitive information of the shareholders, yet he is willing to assist me in getting those information if I give him my personal details and purpose of requesting. 

Come on, "Dr" Sow, you must be kidding.  Didn't you read my email ? My email said :  I will also arrange a press conference to seek the media's coverage of this Disposal in order to gather public and shareholders' support to convene an Extraordinary General Meeting to remove you and the entire board of directors of DPS Resources Berhad for failing in your fiduciary duty as a director to protect the shareholders' interests.

I don't think you, your lawyers or Nazri miss this long paragragh. Your intention in seeking my personal detail is utterly mala fide. That's very glaring what you are trying to do. 

I have given you an opportunity to explain to me and all the shareholders of DPS Resources Bhd at large. You flunked it. And there is no second chance.

I am going to call for an Extraordinary General Meeting soon. Be there to be bombarded and please stand ready to answer, it may be your last day as a director of DPS Resources Bhd, along with the rest of the board members.

But before this EGM is going to take place, I am instructing my lawyers to write to all relevant enforcement agencies for a probe onto what have happened to DPS Resources Bhd during "Dr. Sow" tenure as a director. Let the perpetrators who have brought down DPS Resources Bhd be dragged to the forecourt of law and justice, and to pay their price to what they have done to DPS Resources Bhd, if any, respectively.
