BEIJING - China on Tuesday removed defence minister Li Shangfu and ousted former foreign minister Qin Gang from its cabinet, state media reported, as part of a major reshuffle of its top leadership.

The news comes after months of speculation about China's cabinet, after Qin was abruptly removed from office without explanation in July, and with Li not having been seen in public for months.

Both Qin and Li are believed by experts to have been personally selected for their roles by President Xi Jinping.

On Tuesday state broadcaster CCTV announced the removals in its regular evening bulletin, but did not give reasons for the ministers' fall from grace.

No replacement for Li as defence minister was announced.

Previously it had been reported that the US government believed Li was under investigation and had been stripped of his ministerial duties, but China had refused to comment on the matter.

Li travelled to Russia in August to attend a security conference near Moscow on August 15. Two days later, the government of Belarus released handout photographs of Li meeting with Belarusian President Alexander Lukashenko in Minsk.

But since then, he has vanished from public view.

Li's now confirmed removal means there is no apparent host for China's regional security dialogue, the Xiangshan Forum, which takes place next week.

Evergrande posts losses of $81 billion over two years as it reports long-delayed results

Evergrande Group, the world’s most indebted property developer, has posted long-delayed financial results as a key part of its debt restructuring, which is shaping up to be one of the largest in Chinese corporate history.

The company reported losses attributable to shareholders of 476 billion yuan ($66 billion) and 106 billion yuan ($15 billion) for 2021 and 2022, respectively, according to a Monday stock exchange filing. Combined net losses for the two years amounted to 582 billion yuan ($81 billion).

This is the first time the group has released results since 2021, when its collapse sparked China’s worst ever property crisis, which continues to weigh on the economy.

Shares in Evergrande have been suspended from trading since March 2022 because of its delay in releasing 2021 results.

To avoid being delisted, Evergrande had to report the results no later than September 20, in addition to meeting other requirements specified by the stock exchange.

The filing also revealed that Evergrande’s total debts had reached 2.437 trillion yuan ($340 billion) by the end of last year.

BEIJING, Sept 23 (Reuters) - Even China's population of 1.4 billion would not be enough to fill all the empty apartments littered across the country, a former official said on Saturday, in a rare public critique of the country's crisis-hit property market.

China's property sector, once the pillar of the economy, has slumped since 2021 when real estate giant China Evergrande Group (3333.HK) defaulted on its debt obligations following a clampdown on new borrowing.

Big-name developers such as Country Garden Holdings (2007.HK) continue to teeter close to default even to this day, keeping home-buyer sentiment depressed.

As of the end of August, the combined floor area of unsold homes stood at 648 million square metres (7 billion square feet), the latest data from the National Bureau of Statistics (NBS) show.

That would be equal to 7.2 million homes, according to Reuters calculations, based on the average home size of 90 square metres.

India accuses China of violating border agreements
Indian defence minister held ‘frank discussions’ with his Chinese counterpart, India’s defence ministry says.

India’s defence minister has accused China of eroding the “entire basis” of ties between the two countries by violating bilateral agreements, a reference to a nearly three-year-old standoff involving thousands of soldiers stationed along their disputed border in the eastern Ladakh region.

Indian Defence Minister Rajnath Singh met with visiting Chinese Defence Minister Li Shangfu and “had frank discussions about the developments in the India-China border areas as well as bilateral relations”, India’s Defence Ministry said on Thursday.
Singh told Li that “development of relations between India and China is premised on the prevalence of peace and tranquillity at the borders,” and that all border issues need to be resolved in accordance with existing agreements and commitments, the ministry said in a statement.

According to navigation data, a Vietnamese Fisheries Surveillance vessel and Chinese Coast Guard ship came within 10 meters of each other.

A Vietnamese ship had a tense encounter with a Chinese vessel inside the country’s Exclusive Economic Zone (EEZ) in the South China Sea on Saturday, according to vessel-tracking data.

The incident, based on vessel-tracking data from Marine Traffic, a ship-tracking website, took place as Vietnam Fisheries Surveillance vessel KN-278 tracked Chinese Coast Guard (CCG) vessel CCG-5205 as it traversed Vietnam’s EEZ. Under international law, a state has exclusive access to the natural resources in the waters and the seabed of its 200-nautical-mile EEZ.

China continues to receive brute criticism from countries that were antagonised after its Ministry of Natural Resources released the controversial map. On Friday (September 1), Vietnam also released a statement saying the map violates its sovereignty over the Spratly and Paracel Islands and jurisdiction over its waters.

It was India that first called out China for the release of the map. During a media interaction, India's External Affairs Minister S Jaishnkar pointed out it wasn't the first time China had come out with a similar move.

"It's an old habit of theirs. These (territories) are very much part of India. This government is very clear what our territories are. Making absurd claims doesn't make others territories yours," the minister was quoted as saying by NDTV.

Philippines
Meanwhile, the Filipino Department of Foreign Affairs said the 2023 edition map is China's latest attempt "to legitimise purported sovereignty and jurisdiction over Philippine features and maritime zones" and "has no basis under international law, particularly the 1982 United Nations Convention on the Law of the Sea (UNCLOS)".

Taiwan
Asked about the map, Taiwanese Foreign Ministry spokesperson Jeff Liu said Taiwan was “absolutely not a part of the People’s Republic of China.”

“No matter how the Chinese government twists its position on Taiwan’s sovereignty, it cannot change the objective fact of our country’s existence," he said in a press briefing.

Malaysia
The Malaysian Foreign Ministry in a statement said the new map holds no binding authority over the country, which “also views the South China Sea as a complex and sensitive matter.”

Despite criticism from all sides, Beijing maintained its arrogant attitude and asked the neighbouring countries to refrain from 'over-interpreting' the map.

“On August 28, the Ministry of Natural Resources of China released the 2023 edition of the standard map. It is a routine practice in China’s exercise of sovereignty in accordance with the law. We hope relevant sides can stay objective and calm, and refrain from over-interpreting the issue,” Wang Wenbin, Chinese foreign ministry spokesperson, was quoted as saying when asked about India’s protest.

Pham Thu Hang, the spokesperson for Vietnam's foreign affairs ministry, said China's sovereignty and maritime claims based on the nine-dash line were "invalid", adding that his country "resolutely opposes all China's claims in the South China Sea based on the dotted line".

More than 50 Join Declaration on Human Rights Violations in Xinjiang

Fifty-one United Nations member countries have issued a joint declaration condemning the Chinese government’s crimes against humanity committed against Uyghurs and other Turkic communities, and calling on Beijing to end its systematic human rights abuses in the Xinjiang region.

International Human Rights Law

The international human rights movement was strengthened when the United Nations General Assembly adopted of the Universal Declaration of Human Rights (UDHR) on 10 December 1948. Drafted as ‘a common standard of achievement for all peoples and nations', the Declaration for the first time in human history spell out basic civil, political, economic, social and cultural rights that all human beings should enjoy. Other instruments have been adopted at the regional level reflecting the particular human rights concerns of the region and providing for specific mechanisms of protection. Most States have also adopted constitutions and other laws which formally protect basic human rights. While international treaties and customary law form the backbone of international human rights law other instruments, such as declarations, guidelines and principles adopted at the international level contribute to its understanding, implementation and development. Respect for human rights requires the establishment of the rule of law at the national and international levels.

International human rights law lays down obligations which States are bound to respect. By becoming parties to international treaties, States assume obligations and duties under international law to respect, to protect and to fulfil human rights. The obligation to respect means that States must refrain from interfering with or curtailing the enjoyment of human rights. The obligation to protect requires States to protect individuals and groups against human rights abuses. The obligation to fulfil means that States must take positive action to facilitate the enjoyment of basic human rights.

Through ratification of international human rights treaties, Governments undertake to put into place domestic measures and legislation compatible with their treaty obligations and duties. Where domestic legal proceedings fail to address human rights abuses, mechanisms and procedures for individual complaints or communications are available at the regional and international levels to help ensure that international human rights standards are indeed respected, implemented, and enforced at the local level.

It applies to all human beings in the universal.

Report recommendations
Among the recommendations that the UN rights office makes in the report, is for the Government to take “prompt steps” to release all individuals arbitrarily imprisoned in XUAR, whether in camps or any other detention centre.

China should let families know the whereabouts of any individuals who have been detained, providing exact locations, and help to establish “safe channels of communication” and allow families to reunite, said the report.

The report calls on China to undertake a full legal review of its national security and counter-terrorism policies in XUAR, “to ensure their full compliance with binding international human rights law” and repeal any laws that fall short of international standards.

It also calls for a prompt Government investigation into allegations of human rights violations in camps and other detention facilities, “including allegations of torture, sexual violence, ill-treatment, forced medical treatment, as well as forced labour and reports of deaths in custody.”

'Interlocking patterns'
OHCHR said that the Government policy in recent years in Xinjiang has “led to interlocking patterns of severe and undue restrictions on a wide range of human rights.”

Even if the VETC system has as China says, “been reduced in scope or wound up”, said OHCHR, “the laws and policies that underpin it remain in place”, leading to an increased use of imprisonment.

The systems of arbitrary detention and related patterns of abuse since 2017, said OHCHR, “come against the backdrop of broader discrimination” against Uyghur and other minorities.

Violations of international law
“This has included far-reaching, arbitrary and discriminatory restrictions on human rights and fundamental freedoms, in violation of international laws and standards”, including restrictions on religious freedom and the rights to privacy and movement.

Furthermore, the report said that Chinese Government policies in the region have “transcended borders”, separating families, “severing” contacts, producing “patterns of intimidations and threats” against the wider Uyghur diaspora who have spoken out about conditions at home.

OHCHR said that the Chinese Government “holds the primary duty to ensure that all laws and policies are brought into compliance with international human rights law and to promptly investigate any allegations of human rights violations, to ensure accountability for perpetrators, and to provide redress to victims.”

‘Rigorous review’
The UN rights office said that Wednesday’s report was “based on a rigorous review of documentary material currently available to the Office, with its credibility assessed in accordance with standard human rights methodology.

“Particular attention was given to the Government’s own laws, policies, data and statements. The Office also requested information and engaged in dialogue and technical exchanges with China throughout the process.”

Published on Ms. Bachelet’s final day of her four-year term in office, the report says that the violations have taken place in the context of the Chinese Government’s assertion that it is targeting terrorists among the Uyghur minority with a counter-extremism strategy that involves the use of so-called Vocational Educational and Training Centres (VETCs), or re-education camps.

In a strongly-worded assessment at the end of the report, OHCHR said that the extent of arbitrary detentions against Uyghur and others, in context of “restrictions and deprivation more generally of fundamental rights, enjoyed individually and collectively, may constitute international crimes, in particular crimes against humanity.”

Twin outflows

China saw outflows from both the current account and capital account in September, official data showed. Contributing factors included a service deficit linked with outbound travel, a slump in direct investment and extended securities-related outflows.

Overseas funds cut their holdings of Chinese sovereign bonds by 13.5 billion yuan (US$1.85 billion) in September, according to data released by China Central Depository & Clearing Co on Friday. Their total holding of the debt dropped to 2.07 trillion yuan, the lowest since March 2021.

China’s stock market downturn is also taking a toll. Global funds sold US$1.6 billion of onshore equities Thursday through trading links with Hong Kong, the most in more than two months, as the benchmark CSI 300 index tumbled to a new low for the year.

With the Shanghai Composite Index dipping below 3,000 on Friday, Morgan Stanley said the exodus from onshore equities has entered “an unprecedented stage” and global funds may keep selling unless there is further policy easing.

The cumulative outflows between Aug 7 and Oct 19 amounted to US$22.1 billion, the biggest in the history of Stock Connect, strategists including Laura Wang wrote in a client note.

Stock Connect refers to the trading links between Hong Kong and mainland China, which were expanded in late 2016 to encompass both the Shanghai and Shenzhen exchanges.

SHANGHAI: Capital is exiting China at the fastest pace in more than seven years, piling extra pressure on the yuan.

The exodus has intensified in recent weeks as the nation’s teetering real estate industry casts a shadow over the world’s second-largest economy even after third-quarter growth surpassed economists’ expectations.

China’s currency regulator — the State Administration of Foreign Exchange — said Friday onshore banks sold a net US$19.4 billion of foreign currencies to their clients last month, the most since November 2018, the height of the US-China trade war.

Banks also sent a net US$53.9 billion overseas on behalf of their customers, the biggest monthly outflow since January 2016, shortly after policymakers engineered a depreciation of the currency in August 2015.

Goldman Sachs Group Inc said it’s seeing a similar trend in its preferred gauge, which aggregates transactions in onshore outright spot market, forward market and an official dataset that measures net payments of the yuan from onshore to offshore.

Net outflows climbed to around US$75 billion in September, the most since late 2016 and an almost 80% increase from August, the firm said in a report.

The outflows are placing downward pressure on the yuan, which has weakened this month in both offshore and onshore trading. The currency is less than 1% away from this year’s lows reached in early September.

The shift in part reflects the divergence between interest rates abroad and those in China, where the central bank has been keeping them low in an effort to revive the economy. That’s widened the gap between US and Chinese yields to the most in over two decades.

“The unfavourable interest-rate spread between China and the US will likely imply persistent depreciation and outflow pressures in coming months,” Goldman analysts led by Maggie Wei and Hui Shan wrote in the note.

CHINESE gamers now have to pay more than double the list price of Nvidia’s flagship consumer graphics card after it was caught up in a US technology export ban on its biggest geopolitical rival.

Prices for the year-old GeForce RTX 4090, originally listed at US$1,599, are now as high as 29,000 yuan (S$5,498) on Alibaba Group Holding’s Taobao marketplace as retailers begin to pull it from their shelves.
