Bursa is expected to process within 3 days before the due date on or before 27th. AAX is already out of the PN17 criterion basically. However,why is the share price still stagnant? Well ,its a matter of belief. Some are still doubtful if its PN 17 status can be lifted...

There is no reason why Bursa will reject the relief from PN 17 since AAX has been improving greatly in terms of financial performance in the interim and in months to come. Time extension is not necessary and out of the question here

Judging from the latest developments , AAX is expected to be lifted out of PN 17 next week.

Operating level back to 90% of pre-shutdown levels doesnt seem to be good enough for its share price to spike. What the market seems to desire is 100% of restoration. Hence, its still a long way for the company to return to normalise........

Unless the financial performance is deteriorating from QR to QR , then restructuring plan is requisite. So far, there has been no sign of financial performance deteriorating but improving to great extent from QR to QR . The future prospect of AAX is bright as they are on the right track at the right time now and there is no cause of concern.

No need for AAX to submit restructuring plan since financial performance has been improved to great extent and more improvements are expected to come in coming months. With that, PN 17 criterion are no longer valid and hence PN 17 status should be lifted accordingly.

Now then AAX 's financial performance has greatly improved and Capital A will benefit from it . With the huge positive cashflow, AAX will be able to pay or advance Cap A to pay off its debts...

Previously , AAX's Shareholders’ fund less than 25% of the total issued and paid up capital has triggered PN17. Following their recent huge financial improvements and more in the coming months,Its shareholders fund is believed to have exceeded well above 25 % mark as a result of which PN 17 should be automatically lifted any moment from now ....

It is believed that AAX has assured with confidence that AAX will be able to make profitability of at least rm300m per qtr x4 = 1.2b per year. It is expected to take less than 10 years to pay off all the debts.

It is likely that Bursa would concede to AAX' s application for upliftment. I believe that Tony must have discussed this with Bursa to agree to it well in advance before submitting.

As expected, request for Time extention again to 28th oct 2023. Hence ,share price is expected to be stagnant if not declining.....many were caught to celebrate prematurely. Those who got stuck have no choice but to wait gruesomely for another 3 months for the final outcome ie uplifting of PN 17.

All the resolutions were collectively and duly made in the BOD. Hence ,no single directors are said to be accountable for the actions but the entire BOD. It is preposterous to single out DL as the only one who is allegedly accused of being in breach of Fiduciary duty. Breach of fiduciary duty must be proven in court ,not by MACC nor by the police. So far , no further charge brought to the PP by the MACC. Because of this reason, the new management has turned to the Police but the outcome is expected to be the same as MACC. No charge is expected. What FL and new management are doing is to buy time to delay the payment of compensation. They will face with the eventuality no matter how.

It is preposterous for the New management to challenge the Letter of Demand ( LD) in terms of fraudulent element .The LD is drafted by the legal profession and the claims stated in the LD are based on Market value of the rental on the trespassed Land. Bahvest has publicly admitted the wrongdoing of trespassing and acknowledged the claims and prepared to negotiate to settle with the non-refundable deposit of RM 13m . Now they denied it. Who doesnt respect the law ? where is the integrity of the new management ?

Basically, the new management is only buying time to delay the compensation by resorting to all these futile exercises such as lodgement of police report for fraud . The truth is that Bahvest under the new management is unable to generate cashflow from its normal operation . They are expected to make huge losses in the upcoming QR and put all the blame on the predecessor management.

AAX has no problem to get its PN 17 lifted as it is flying stronger and stronger in terms of demand...

Thats why I am saying it is not a matter of size but " valid grounds" to win the case. Though Apple has the size, it is not necessarily that they could win the case as their infringement of patent by Apple can be clearly established. They must respect the law and not to twist the law.

Why is AAX plunging today ? It seems to be the sign of disapproval of shareholders to the RP. The shareholders are said not to be pleased with their massive sacrifice for Cap A without due consideration in return. RP could be announced to be dead again .

It is believed that the Creditors and lenders are cautious and considerate .If they are too harsh to AAX and Cap A , they will get lesser than expected when the companies are put out of business ie receivership followed by liquidation . If the shareholders of AAX were keen to salvage Cap A , they would have approved the regularisation plan( RP) fast. The way it goes with the repetitive requests for time extension for submission of RP of both companies is demonstration of the disapproval of shareholders of AAX ( Mostly ) and their being reluctant to go ahead with the RP. For Cap A, it is do or die situation, they have no choice but to be salvaged at the mercy of AAX.
