Tun Daim seeks MACC report in asset disclosure case

FORMER finance minister Tun Daim Zainuddin is requesting the Malaysian Anti-Corruption Commission (MACC) report that initiated the criminal investigation against him.

Daim argued that obtaining the report is crucial for ensuring a fair trial in his ongoing asset-disclosure court case.

In an affidavit submitted last Wednesday (July 31), Daim claimed that prosecutors have either failed or refused to provide the report despite his lawyers’ request on Jan 31. He asserted that the report is vital for a fair trial, aligning with his constitutional rights under Article 5 of the Federal Constitution.

“The complaint (MACC report) is relevant to ensure a fair trial of the charge, consistent with my right under Article 5 of the Federal Constitution.

“The complaint is relevant for this court to reach a fair and just decision upon the charge against me.”

Daim, 85, faces a charge under Section 36(2) of the MACC Act 2009 for allegedly failing to comply with the anti-graft agency’s notice to disclose his assets.

The charge stems from his alleged failure to fully disclose details of 38 firms, 25 pieces of land and property, seven luxury vehicles, and two investment fund accounts.

The application for the report was brought before the Kuala Lumpur Sessions Court this morning.

During the proceedings, Deputy Public Prosecutor Datuk Wan Shaharuddin Wan Ladin indicated that the prosecution would oppose Daim’s application. Judge Azura Alwi has scheduled a hearing for Aug 27 to review Daim’s request.

Daim is accused of not complying with the MACC notice between Dec 13 and 14 of the previous year, and if convicted, he faces up to five years in prison and a fine of up to RM100,000. He was released on RM280,000 bail with one surety.

Meanwhile, Daim’s wife Na’imah Abdul Khalid is facing a similar criminal charge in a lower court. - Aug 8, 2024
