Kelantan speaker’s decision validates Bersatu’s anti-hopping law

BERSATU president Tan Sri Muhyiddin Yassin has stated that the recent decision by the Kelantan state assembly speaker Datuk Mohd Amar Nik Abdullah to declare the Nenggiri seat vacant substantiates the legality of the party’s recent constitutional amendment.

Mohd Amar declared the seat vacant after receiving notice that the assemblyman for Nenggiri, Mohd Azizi Abu Naim, had ceased to be a Bersatu member.

This move aligns with Article 31 (A) of the Kelantan State Constitution, which stipulates that a state seat can be vacated if the incumbent leaves their party.

“This provision is in line with the anti-hopping law under the Federal Constitution,” Muhyiddin said in a statement.”

He added that the decision also demonstrated the legitimacy of Bersatu’s constitutional amendment addressing party hopping and the subsequent notices issued to its dissenting elected representatives.

“Bersatu and Perikatan Nasional are ready to face a by-election for the Nenggiri seat.”

The declaration follows a recent announcement on last Wednesday (June 12) by Bersatu’s secretary-general Datuk Seri Hamzah Zainudin, who revealed that six elected representatives had been expelled from the party for contravening its constitution.

This group includes not only Mohd Azizi but also Labuan MP Datuk Dr Suhaili Abdul Rahman, Jeli MP Zahari Kechik, Kuala Kangsar MP Datuk Iskandar Dzulkarnain Abdul Khalid, Bukit Gantang MP Datuk Syed Abu Hussin Hafiz Syed Abdul Fasal and Tanjong Karang MP Datuk Dr Zulkafperi Hanapi. - June 19, 2024
