Cupertino, California — February 17, 2020 — As the public health response to COVID-19 continues, our thoughts remain with the communities and individuals most deeply affected by the disease, and with those working around the clock to contain its spread and to treat the ill. Apple is more than doubling our previously announced donation to support this historic public health effort.
Our quarterly guidance issued on January 28, 2020 reflected the best information available at the time as well as our best estimates about the pace of return to work following the end of the extended Chinese New Year holiday on February 10. Work is starting to resume around the country, but we are experiencing a slower return to normal conditions than we had anticipated. As a result, we do not expect to meet the revenue guidance we provided for the March quarter due to two main factors.

The first is that worldwide iPhone supply will be temporarily constrained. While our iPhone manufacturing partner sites are located outside the Hubei province — and while all of these facilities have reopened — they are ramping up more slowly than we had anticipated. The health and well-being of every person who helps make these products possible is our paramount priority, and we are working in close consultation with our suppliers and public health experts as this ramp continues. These iPhone supply shortages will temporarily affect revenues worldwide.
The second is that demand for our products within China has been affected. All of our stores in China and many of our partner stores have been closed. Additionally, stores that are open have been operating at reduced hours and with very low customer traffic. We are gradually reopening our retail stores and will continue to do so as steadily and safely as we can. Our corporate offices and contact centers in China are open, and our online stores have remained open throughout.
Outside of China, customer demand across our product and service categories has been strong to date and in line with our expectations.

The situation is evolving, and we will provide more information during our next earnings call in April. Apple is fundamentally strong, and this disruption to our business is only temporary. Broadcom’s new BCM4389 chip brings Wi-Fi 6E support to smartphones
Wi-Fi 6E is an extension to the Wi-Fi 6 standard and it lets devices operate in the 6 GHz spectrum. An additional 1200MHz can be split into fourteen 80MHz or seven wider 160MHz channels, thus offering higher throughputs. It was announced just over a month ago by the Wi-Fi Alliance, but the FCC still hasn’t approved the use of the 6 GHz spectrum. Though, it looks like Broadcom is placing its bets to become among one of the first to adopt it. The company’s new BCM4389 is a WiFi 6E and Bluetooth 5.0 compatible chip with a couple of welcoming features.

BCM4389 uses a 16nm manufacturing process in comparison to 28nm found on its predecessor, BCM4375. If you need a refresher of the brain, the smaller the nanometer manufacturing process of the chipset, the smaller the distance between transistors. This results in faster and more power-efficient operating of the device. BCM4389 also supports Tri-band Simultaneous (TBS) radio which uses the third radio for background scans and checks which doesn’t require much power.

Broadcom also promised Bluetooth improvements, such as two times faster pairing time and the support of BT MIMO. The latter will theoretically eliminate audio chopping on Bluetooth connected devices. BCM4389 also doubles the maximum bandwidth capability to 2 Gbps in smartphones.

Broadcom chipsets are used by companies such as Apple and Samsung in their mainstream smartphone series. I would expect the arrival of Wi-Fi 6E supported devices by next year. FCC approval should also be in place by that time.

- Johnson said there was “complete certainty” that a deal will be finished by the end of 2020. Britain is currently operating under EU rules during a time-limited transition period.

- He said there were two types of deal available:

1. A deeper trading relationship on the lines of the free trade agreement the EU has with Canada.

2. A relationship based simply on the Brexit Withdrawal Agreement deal agreed in Oct. 2019.

- Any deal cannot include “any regulatory alignment, any jurisdiction for the CJEU (Court of Justice of the European Union) over the UK’s laws, or any supranational control in any area, including the UK’s borders and immigration policy”.

- Johnson said he wants a “suite of agreements” covering:

1. A comprehensive free trade agreement covering substantially all trade.

2. An agreement on fisheries.

3. An agreement to cooperate in the area of internal security.

4. A number of more technical agreements covering areas such as aviation or civil nuclear cooperation.

- All these should have “governance and dispute settlement arrangements appropriate to a relationship of sovereign equals”.

THE FREE TRADE DEAL
Johnson set out 12 areas he believed the deal should cover:

1. National Treatment and Market Access for Goods

“There should be no tariffs, fees, charges or quantitative restrictions between the UK and the EU. There should be a protocol setting out appropriate and modern rules of origin, in order to facilitate trade between the parties to the greatest extent possible.”

2. Trade Remedies

“The agreement should enable the UK to protect its industry from harm caused by unexpected surges in imports of goods or by unfair trading practices, while making the appropriate commitments to transparency, due process and proportionate use of trade remedies.”

3. Technical Barriers to Trade

“There should be provisions to address regulatory barriers to trade in goods, providing for cooperation on technical regulation, standards, conformity assessment procedures and market surveillance, building on the WTO Technical Barriers to Trade Agreement.

“Annexes to the agreement could include provisions facilitating trade in specific sectors, such as organic products, motor vehicles, chemicals and pharmaceuticals, as well as mutual recognition agreements focusing on conformity assessment, with full coverage of the relevant sectors.”

4. Sanitary and Phytosanitary Measures

“The UK will maintain its own autonomous sanitary and phytosanitary regime to protect human, animal and plant life and health and the environment, reflecting its existing high standards.

“In certain areas it may be possible to agree equivalence provisions to reduce practical barriers to trade at the border.”

5. Customs and Trade Facilitation

“Facilitative customs arrangements, covering all trade in goods, should be put in place in order to smooth trade between the UK and the EU.”

6. Cross-Border Trade in Services and Investment

“Significant provisions on trade in services are an essential component of a comprehensive FTA. Accordingly, the Agreement should include measures to minimize barriers to the cross-border supply of services and investment, on the basis of each side’s commitments in existing FTAs.

“In areas of key interest, such as professional and business services, there may be scope to go beyond these commitments.”

7. Temporary Entry for Business Purposes

“The agreement should include significant reciprocal commitments on the temporary entry and stay of individuals, so that both EU and UK nationals can undertake short-term business trips to supply services.”

8. Regulatory Framework

“There should be measures that reduce unnecessary barriers to trade in services, streamlining practical processes and providing for appropriate regulatory cooperation.”

9. Mutual Recognition of Professional Qualifications

“The Agreement should provide a pathway for the mutual recognition of UK and EU qualifications, underpinned by regulatory cooperation, so that qualification requirements do not become an unnecessary barrier to trade.”

10. Financial Services

“The Agreement should require both sides to provide a predictable, transparent, and business-friendly environment for financial services firms, ensuring financial stability and providing certainty for both business and regulatory authorities, and with obligations on market access and fair competition.

“Given the depth of the relationship in this area, there should also be enhanced provision for regulatory and supervisory cooperation arrangements with the EU, and for the structured withdrawal of equivalence findings.”

11. Road Transport

“There should be reciprocal commitments to allow EU and UK road transport operators to provide services to, from and through each other’s territories, with associated rights, underpinned by relevant international agreements and commitments, and

Airbus' Deferred Prosecution Agreement


SEPANG, 1 February 2020 -- AirAsia refers to the article entitled “AirAsia directors/staff got RM240 mil bribe from Airbus, court docs say” on the focusmalaysia.my website, as well as other articles in the press regarding the Deferred Prosecution Agreement entered into by Airbus SE and the U.K. Serious Fraud Office (SFO) on 31 January 2020. At the outset, AirAsia wishes to clearly state that it was neither involved in any way whatsoever with the SFO’s investigation of Airbus nor given any opportunity to provide any information or clarification to the SFO.

The articles referenced above allege that certain agreements by AirAsia to order Airbus aircraft were improperly linked to sponsorship by Airbus of a sports team jointly owned by AirAsia executives. AirAsia vigorously rejects and denies any and all allegations of wrongdoing.

The entering into of each aircraft purchase agreement was never made by any single individual decision, but instead arrived at through careful evaluation, deliberation and the collective decision of the board members after taking into account technical specifications, aircraft flight performance and operating economics. The superiority and reliability of the aircraft and increasingly attractive pricing being offered to maintain our competitive edge in the airline business were key considerations. As a customer of Airbus since 2005, AirAsia never made purchase decisions that were premised on an Airbus sponsorship.

We also wish to emphasise that all negotiations and dealings leading to the signing of any aircraft purchase agreement have been undertaken directly with Airbus on an arm’s length basis, and without the involvement of any third parties or intermediaries. AirAsia executives negotiated rigorously in the interests of the company and had at all times acted in good faith. In any event, AirAsia is aware that correspondence between the company and Airbus dating back more than a decade has been reported in the press without proper context or review, and we are concerned that views and opinions on the matter may have been formed unfairly and prematurely.

Furthermore, the involvement of Airbus in the sponsorship of the sports team was a well-known and widely-publicised matter bringing branding and other benefits to Airbus. AirAsia’s own sponsorship of the sports team went through due internal assessment and approvals before being considered and approved by the board.

As AirAsia and its executives have no visibility on Airbus’ internal processes, we cannot comment on or be associated with any alleged failures or lapses on the part of Airbus to comply with its own policies or applicable legal requirements.

AirAsia is deeply concerned that these allegations will have an adverse and negative impact on the AirAsia brand, reputation and goodwill. AirAsia is monitoring developments in this matter and will review any allegations or negative inferences concerning or affecting AirAsia and/or any of its executives and will fully cooperate with the Malaysian Anti-Corruption Commission and the relevant authorities where required.
