MUDA criticises Home Minister’s stance on UNCAT ratification

MUDA central executive committee member Dobby Chew has criticised Home Minister Datuk Seri Saifuddin Nasution Ismail following his statement in Parliament that Malaysia currently has no intention to ratify the United Nations Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UNCAT).
 
In a statement released today, Chew questioned the rationale behind Saifuddin’s reference to Malaysia’s laws on caning and whipping as reasons for not ratifying the convention.
 
“Caning and whipping have always been an issue of contention within UNCAT.
 
“However, this has not prevented numerous countries that impose caning and whipping in their jurisdiction from ratifying UNCAT. This also includes countries that maintain and practise shariah law,” he stated.
 
Chew pointed out that the Home Minister, who oversees various enforcement agencies, should focus on the core message of UNCAT which is the prevention of torture, rather than being sidetracked by the issues of caning and whipping.
 
He also challenged Saifuddin on the unresolved cases of past custodial deaths, following the minister’s claim that no deaths in police custody inflicted by authorities have occurred since he took over the ministry.
 
According to Saifuddin, all deaths recorded in prisons, police lockups, and Immigration Department depots since 2022 were health-related.
 
“While it is commendable that deaths in police custody have been reduced within the government records, past custodial cases remain unresolved with perpetrators of torture and abuse in custody walking free,” Chew remarked.
 
“Until today, the Madani government has yet to address Teoh Beng Hock’s death. They have not initiated criminal actions against the perpetrators either.”
 
Moreover, he called for the government to demonstrate sincerity in preventing torture by holding a formal public inquiry into custodial deaths and prosecuting those involved in torture and abuse in custody.
 
Chew also urged for a study on how Malaysia could achieve ratification of UNCAT, alongside the introduction of appropriate legislation and amendments to criminalise torture by enforcement agencies and state actors.
