Kelantan Mufti: Divorce should be before Syariah court, not on social media

KOTA BARU: Divorce in Islam should be handled with dignity, ideally before a Syariah Court judge, rather than through other methods such as live broadcasts on social media.

Kelantan Mufti Datuk Mohamad Shukri Mohamad said marriage is a significant Islamic practice that should proceed peacefully, safely, and happily.

He said any disagreements should be resolved amicably, as advocated by Islam.

"Before marriage, Islamic customs such as engagement, 'merisik' (inquiry about the prospective spouse), and other initial steps are taken.

"Therefore, if divorce becomes necessary, it should be conducted respectfully, as advised by Islam.

"We should maintain brotherhood and Islamic kinship without fostering resentment," he said when contacted today.

His remarks came on the heels of a recent divorce case where a 37-year-old online cosmetic trader was divorced by her husband, in his 40s, while she was live streaming on TikTok. 

Mohamad Shukri said those seeking a divorce should appear together before a Syariah Court judge.

"Why do we sensationalise divorces? We are concerned that such adverse incidents could become commonplace and influence others.

"Positive events should be highlighted, but negative issues like divorce shouldn't be sensationalised," he said.

He also advised against rushing into divorce during marital disputes and stressed the importance of resolving issues through proper channels.
