澳大利亚暂停与香港的引渡机制 为港人提供避风港签证

华盛顿 —
继加拿大等国之后，澳大利亚周四（7月9日）宣布，暂停与香港之间的引渡条约，并愿意为香港居民和企业提供移民和搬迁帮助。这是澳大利亚对北京在香港推行国家安全法后采取的一项重要举措。

澳港引渡条约环境发生根本性变化

澳大利亚总理莫里森宣布，有一部分签证有效期将从两年延长至五年，并将为希望离开香港的人们提供获得公民身份的途径。目前还不清楚有多少香港居民将会得到这些签证优惠。

莫里森表示，从香港来澳大利亚的在校学生或技术移民签证持有人将获得额外的五年签证，并获得永久居留权。他补充说，以后的学生或技术移民签证申请人也可以获得这五年的签证。

中国跳过香港立法会和公开咨询程序在香港强推影响广泛的国安法引起世界范围的不安。批评者称这种做法严重伤害了香港居民自由权利。中共曾在香港回归中国之前做出国际承诺，香港在英国管理时期形成的政治、经济、社会制度在50年内将保持不变。

国安法规定所谓分裂国家、颠覆政府、恐怖袭击和与境外反华势力勾结等四种行为构成刑事犯罪。此法赋予警察广泛的权力，可以在没有搜查证的情况下进行搜查，可以命令网络服务提供商和信息平台删除所谓的违法信息。

莫里森说：“我们的政府和世界其它国家的政府都对在香港强推国安法的做法表示持续的关切。”

莫里森指出：“国安法已经引起我们与香港引渡条约方面的根本性变化。”

根据新的签证规定，现在在澳大利亚的临时签证持有者和学生签证持有者可以延长签证时间，到期后他们还可以申请永久居住签证。这些人的人数大约有一万多人。

这是澳大利亚第二次提供“避风港签证”。上次是在1989年北京发生天安门镇压民主运动事件后之后。澳大利亚给在澳的中国人提供了这种签证，让当时约27000多名中国学生得到了绿卡。

中方向澳大利亚发出粗暴威胁

中国驻澳大利亚使馆指责澳大利亚的做法“严重违反了国际法和国际关系的基本准则”。

中国驻澳使馆在一份声明中说：“我们敦促澳大利亚方面立即停止干预香港事务和中国的内政。”“否则将会搬起石头砸自己的脚。”

在此之前，英国已经表示，同意把300万持有英国国民海外护照的香港居民在英国的居住和工作期限延长至五年，并为他们加入英国国籍提供方便。

加拿大之前已经决定暂停与香港之间的引渡条约，并表示正在研究包括移民在内的其它措施帮助香港居民。

中共机关报人民日报旗下的一家民粹主义小报环球时报对澳大利亚的这一举措发出威胁，称不要低估双边关系的进一步恶化对澳大利亚经济产生的影响。

中国外交部发言人赵立坚也于周四谴责澳大利亚“严重违反国际法和国际关系基本准则，粗暴干涉中国内政。”

这位被网民称为“战狼发言人”的赵立坚还以非常粗野的方式向澳大利亚发出威胁说“中方不吃这一套，对此表示强烈谴责，并保留进一步作出反应的权利，由此造成的一切后果将完全由澳方承担。”

澳大利亚还表示为愿意迁往澳大利亚的香港企业提供帮助。澳大利亚广播公司报道说，新的签证政策可能会影响到目前在澳大利亚读书的10500名香港学生和另外1500名持相关签证的香港人。

莫里森说：“我们今天做出的这些决定将会对那些已经在澳大利亚的大约一万（香港）人产生最重要的影响。”

澳大利亚决定暂停与香港的引渡条约是担心，澳港引渡条约如果不暂停，被引渡到香港的人就可能会被送到中国大陆，受到中共的迫害。

悉尼大学法学院教授凌兵表示，澳大利亚没有别的选择，只能暂停引渡条约。

澳广引用凌兵的话说：“任何引渡条约都需要两个司法体系之间存在信任。” “一方把人引渡到另一方，就要求另一方能够公平地对待刑事被告。”

凌兵说：“我认为把人引渡到香港就存在这种风险，被引渡者最后可能会被送到中国大陆。”
