祸不单行, 另外一个法律的枷锁也可能在陈必荣面前搖晃。这当中也包括蔡利成。他们在 2004年三月份向拿督承诺了那个具有双部分的企业商议, 他们也向拿督供应了具优惠价的五百万股初期股票

陈必荣 (Tan Bee Eng) 这么做全是为了放长线钓大鱼, 因为他深知若是利兴的股价一天不在高位, 拿督是不可能为他们的 32%利兴股权寻得买家的。

根据利兴公司登记处 Plantation Agencies Sdn. Bhd. (公司号码 2603-D) 一份志期 12-10-2004 的首 150大股东名册, 利兴的公众持股量在截至 8-10-2004 为止只有 8.86%。若是当初利兴董事局据实公布此 8.86% 而不是那掩眼法的 960名股东人数, 利兴股票早就应该在 18-10-2004 该文告公布的当天便即时被強制无限期的停牌了。而利兴也不再是一间由大众持有的公共公司, 技术上和法律上已不能够继续在大马股票交易所掛牌上市
