The Concise Dictionary Of Law describes the sub judice rule as “a rule limiting comment and disclosure relating to judicial proceedings, in order not to prejudge the issue or influence the jury”.

Of common law origin, the sub judice rule was applicable to criminal trials since the ultimate decision-maker is the panel of jurors, which comprises laymen who are non-professionals.

However, criminal cases are now conducted by a judge when the jury system was effectively abolished on 1st January 1995.

The sub judice rule ought not be inapplicable due to the absence of jury trials.

In addition, there will not be any witnesses in originating summons (OS) actions and consequently the issue on sub judice is largely irrelevant.


In Goldsmith v. Sperrings Ltd [1977] 2 All ER 566, Lord Denning MR had this to say:-

“In a civilized society, legal process is the machinery for keeping order and doing justice. It can be used properly or it can be abused. It is used properly when it is invoked for the vindication of men’s rights or the enforcement of just claims. It is abused when it is diverted from its true course so as to serve extortion or oppression; or to exert pressure so as to achieve an improper end. When it is so abused, it is a tort, a wrong known to the law”

Haha i3lurker,
The Malaysia education ultimate objective is to set examination questions that will pass all the students.

When question start with think that mean all will be passed. I think 1+1=3 or any number are all the correct answer because the question ask you to think and not ask you to calculate.

So I think I can fly and Serbadk RM 3.00 coming.

（吉隆坡30日讯）世霸动力（SERBADK，5279，主板能源股）审计疑云历时超过半年，但整个事件依然迷雾重重，独立审计师安永（EY）在特别调查中也和前外部审计师毕马威（KPMG）提出多项疑虑，存疑的账目金额或高达14.38亿令吉！

世霸动力今天向交易所报备，已于本月25日，披露接获马交提呈于高庭的原诉传票（Originating Summons），并透露了传票内容。

内容显示，安永受命针对世霸前外部审计师毕马威提出的4个事项，即1）与某些客户的销售交易、应收账款和余额确认；2）本地供应商的某些采购交易和应付账款余额；3）信息技术合同的应收账款和销售交易；以及4）有关巴林客户和供应商的更多信息等事项，进行独立审计。

针对事项（1），最新调查结果显示，“安永调查后，对11名已识别客户交易的真实性提出质疑。”涉及金额：4.35亿令吉。

事项（2）的调查结果显示，“安永调查后，对6家已识别本地供应商交易的真实性表示担忧。”涉及金额：6.38亿令吉。

事项（3）的调查结果则显示，“安永调查发现，与5家已识别客户，和一家已识别供应商的合同存在异常状况。此外，安永还发现了，毕马威未识别的其他客户和供应商的异常状况。”涉及金额：7600万美元（约3.15亿令吉）。

事项（4）调查结果则显示，“安永调查发现，巴林客户可能与公司（世霸动力）相关；安永也对与巴林供应商交易的真实性提出质疑。”涉及金额：1200万美元（4977万令吉）。

针对马交所提出的原诉传票，世霸动力表明将积极辩护，并于本月26日提交申请，以修改最新调查结果，以及宣誓书中提及调查结果的相关段落。

文告也指出，高庭于本月29日决定，将该调查结果封锁，禁止外人查看或下载。

“高庭已顶下，明年1月3日聆审该原诉传票；而世霸针对马交所提出的原诉传票，则将于12月10日聆审。”

Even if serba wins all its lawsuits against kpmg, ey, bursa n the edge…..audited accounts as at 30 June 2021 must still be submitted asap & coupon payments must be paid & usd sukuk must be paid in next maturity sometime in May 2022.

So, what we do now is WAIT correct?
