I totally agreed with you that any decision/action can be challenged.
But there is such thing known as frivolous suit.

What dis Bursa did wrong?
KMPG highlighted irregularities in accounts.
So Bursa wanted an audit.
Bursa proposed EY and SD agreed.
EY briefed ED of SD and Bursa.
Bursa deemed price sensitive info.
SD said no.
Bursa did not suspend until Mr Karim dealt with the shares and warrant with inside info of SIR.

In its legal action against Bursa Securities, Serba Dinamik has alleged that the market regulator has acted grossly in excess of authority and there is an underlying theme that it had interfered in the company’s audit process.

It further revealed that in the months of June and July, Bursa Securities had issued a directive to the company to appoint EY as the company’s special auditor to conduct a special independent review (SIR) with regard to auditing issues raised by the company’s previous external auditor KPMG PLT.

Serba is great with all the government agencies except SC and Bursa. They even representing Malaysia in Dubai Expo..

While Ernst & Young Consulting Sdn Bhd may or may not take on auditing jobs, the company definitely has chartered accountants that are qualified to perform audits.

It was Serba's BOD that chose Ernst & Young Consulting Sdn Bhd to perform the independent review. If indeed Serba made a wrong choice of company to perform the independent review, they cannot take advantage of their own wrong doing.

To my limited knowledge, usually it's people with big influence/political power will go rogue like this in order to protect their interest. Or perhaps I'm just thinking too much LOL!
