“This is because the Dewan Rakyat is the institution that functions to create or amend an Act. But this did not happen this morning.
“Therefore, I am of the view that the latest statement by the Honourable Minister intends to ‘find a way out’ to soothe the anger of netizens. And most unfortunate, his statement in fact still does not clearly state that a Finas licence is not required by social media users on platforms such as TikTok, YouTube, and so on.
Fahmi, who is also PKR’s spokesman on communications, arts and culture, said this is not the only gaffe made by Saifuddin since taking over the ministerial position in March this year.
He cited the latter’s withdrawal of Eric Paulsen’s appointment to the Communications and Multimedia Consultative Council and the revocation of the broadband line spectrum.
“I think after three episodes of missteps since his appointment as minister — (1) the appointment of Mr Eric Paulsen to the Communications and Multimedia Consultative Council, which was withdrawn after it was disputed by various parties; (2) revocation of the 700MHz, 900MHz and 2600MHz spectrum allocations after it was disputed by various parties; and the latest (3) Finas licence issue today which is disputed by various parties — it is time for the minister of communications and multimedia to resign,” he said.
Earlier today, Saifuddin said all productions of films and recording — whether by media agencies or individual media outlets — must apply for a licence before commencing.
He said under the Finas Act, film producers are required to inform the corporation via existing channels seven days prior to filming, and this even includes media meant for social media platforms.
“Film producers must apply for a Film Production Licence and Film Shooting Certificate (SPP) regardless of whether they are mainstream media agencies or personal media which produce films on social media platforms or traditional channels,” Saifuddin said during Minister’s Question Time in Parliament today.
The issue was brought up after Saifuddin said his ministry will check if Al Jazeera had obtained a licence from Finas to produce the documentary before it started production, saying that a lack of licence would be considered an offence as permission from Finas is needed before films and documentaries can be produced in Malaysia.
He said that the Information Department will cancel Al Jazeera’s media accreditation if it was found to have violated such conditions, noting that the crew would not be free to go anywhere without the media cards issued by the department.
Yesterday, the Foreign Correspondents Club of Malaysia (FCCM) said it was unaware of any requirement to obtain permission from Finas for any news video production, and there was no such issue in the past.
The “minister” said that all forms of filming, including those for personal social media use, requires a license from Finas. Then the “minister” said when the National Film Development Corporation Act 1981 was enacted, the “social media” phenomenon had not happened so the Act is now inadequate to cover this new phenomena. But yet, he wanted the act to be enforced on all social media videos. Isn’t this a moronic stand, Mr “Minister”? You know fully well the Act is totally inadequate to cover the social media videos and yet you try to to say all handphone videos need a license from Finas. You are basically saying everyone in Malaysia who owns a handphone and who takes a video shot once a while requires a licence from Finas. Not only that, the person need to have a “Sendirian Berhad” company. So does it mean that , if a person does not have a “Sendirian Berhad” company, the person cannot take any video using a handphone? It is common for 8 year-old kids who own handphones to take videos nowadays. How do they apply for filming licenses, given that they are 8 years old? Care to give an explanation, Mr Finas Minister?
Saifuddin, Art Harun, Wan Saiful...these are the so-called "progressive" Malays who are now exposed as totally devoid of principles or ethics and motivated only by self-interest.
There was a photo showing dewan rakyat speaker Art Harun bowing so low to kiss the hand of MP Hadi Awang the PAS leader. Where is the health ministry SOP of no handshake (let alone handkissing) in the light of the covid-19 pandemic when a mere slight bow with the right hand on the left chest will do? Imagine the speaker paying homage to an MP (even thoigh outside parliament) when MPs normally bow before the, speaker in the dewan rakyat! Where is the speaker"s maruah?
This MINISTER, ex UMNO, ex PH, now PN is part of the “Penghianat Gang “ that brought down PH Government elected by the Rakyat ! Now he is trying to cripple the freedom of the rakyAT. BUT, HE IS CONFUSED AND CANNOT REPLY CORRECTLY TO MEMBERS QUESTIONS. HE IS THE SAME PERSON UNDER PH WHO ACCUSED UMNO AS “DEEP STATE “ ! HE LOST ALL CREDIBILITY NOW. YB FAHMY’S CALL FOR HIM TO RESIGN IS TIMELY. ALL THE FROGS NEED TO BE ELIMINATED ONE BY ONE.
Put the pressure on them ! Where’s is DSAI? Why quite like a mouse? When PH in power UMNO /PAS ever ready for street demonstrations? Be seen as a fighter and not a mouse !
In a span of 4 months being a minister you have misstepped & flip flopped 3 times on the 5G license, Eric Paulsen’s appointment & now on the use of Finas Act, not to mention how you performed as a Foreign Minister during PH. It’s time for you to resign as you have failed Malaysians terribly & we have become a laughing stock to the world.
Hey guys, we are talking about the quality standard of Malaysian ministers, we are not talking about Singapore standard, so we should not have high expectation, they are just primary school standard n always n forever lack of commonsense n intellectual in carrying out their works.
Singapore ministers graduated from top notch universities, Malaysian ministers : fake degree, no degree, flying cars, black shoe n so on. After 60 years. Malaysia is still going backward everyday. Compared to Singapore, Malaysia is like a third world nation. Why? Because of the poor quality of Malaysian ministers
And together with Menteri Air Suam and Menteri Dalam PPE, this lying, backpedaling and spineless cretin of a minister will hasten the demise of this gomen of power hungry fools
All film producers must apply for Finas licence even for social media, multimedia minister insists
All production of films and recording regardless of whether media agencies or individual media outlets must apply for licence before filming, Communications and Multimedia Minister Datuk Saifuddin Abdullah insisted today.
Saifuddin said under the National Film Development Corporation (Finas) Act, film producers are required to inform the corporation via existing channels seven days prior to filming date, and this even includes media meant for social media platforms.
“Film producers must apply for Film Production License and Film Shooting Certificate (SPP) regardless of whether they are mainstream media agencies or personal media which produce films on social media platforms or traditional channels,” Saifuddin said during the minister’s question time at Parliament today.
Yesterday, the Foreign Correspondents Club of Malaysia (FCCM) said it was unaware of any requirement to obtain permission from Finas for any news video production, and there was no such issue in the past.
During the minister’s question time, Saifuddin was responding to Kluang DAP MP Wong Shu Qi who asked the minister to state whether all film producers will be made compulsory to apply for SPP, regardless of whether they are a mainstream media agencies or personal media which produce films on social media platforms or traditional channels.
According to Saifuddin, who cited the National FIlm Development Corporation Act 1982, Section 22(1), said “no person shall participate in any production activities, distribute and exhibit films or any combination the activities specified in Section 21(1) unless a licence is issued authorising him to do so”.
He added that the Additional Conditions of Film Production under Regulations 4 of the Act (Licensing) 1983, Condition (1) that is enforced, “licensees, if filming, should inform the corporation no later than seven days before filming a movie begins through certain forms issued by the corporation”.
“By submission of the form, the SPP will be issued by the corporation,” he said, referring to Finas.
Among other things, Finas’ functions under the Act include the development of the film industry, and the regulation and control of the production, distribution and exhibition of films in Malaysia and to issue licences for such purposes.
Wong’s question came after Saifuddin reportedly said his ministry will check if Al Jazeera had obtained a licence from Finas to produce the documentary — Locked Up in Malaysia’s Lockdown — which was aired on its 101 East weekly current affairs show — before it started production, saying that a lack of licence would be considered an offence as permission from Finas is needed before films and documentaries can be produced in Malaysia.
The news outlet has since dismissed claims by Finas that it did not have the necessary licence to film or air its documentary on the alleged mistreatment of migrants in Malaysia.
Al Jazeera English managing director Giles Trendle had in a statement yesterday said that per Finas’ own definition, its 101 East weekly current affairs show does not fall into the category of film requiring a licence.
He also said the authorities, unable to contest the integrity of their journalism, are now attempting this new gambit of claiming the news outlet did not have a proper licence.
Individual like me how? Need to join the Finas's listed associations? Then apply with Mida to obtain their approval letter only then apply with Finas?
I was thinking to upload my grand child's full moon celebration....look like by the time I got all the approval my grand child will be celebrating two years old birthday.
Wah. Sounds like bureaucracy gone mad. And basically it is impossible for an individual to get a licence to make a video let alone posting it online. The next time I see some one “capturing the moment” with their phone I better ask to see their licence. Complete lunacy!
A golden opportunity for jobless youths to apply for screening jobs at Finas. Better do it online. Everybody can then apply as age is non-issue as long as u have keen eyesight and sharp critical political minds.
